This responds to your request for information on the reference to “gold coins having a recognized special value to collectors of rare and unusual coins” in Executive Orders 6102 and 6260, which are the subject of a CRS Memorandum, “A Brief Examination of the History of Executive Orders 6102 and 6260 Relating to the Hoarding of Gold Coins and Bullion,” by Josiah Heidt, formerly a law clerk in the American Law Division.1 You are particularly concerned about: (1) how that phrase was defined under Executive Orders 6102 and 6260, issued on April 5 and August 28, 1933, respectively, and (2) the current status of Executive Branch authority to prohibit the hoarding of gold coins and bullion.
